All orders placed through the seller's online store are considered binding. By checking the box before sending the order, the buyer confirms that he has read these terms and conditions and the complaint procedure and understood their content. The terms and conditions in question will apply to all purchase contracts between the buyer and the seller that are concluded through the online store as distance contracts and to all relationships arising from them.
We offer you the opportunity to purchase directly from your home, where you can shop non-stop. You can order simply and conveniently using the shopping cart, phone, e-mail, or in writing at our address. The subject of the contract is only the goods specified in the purchase contract - order.
We undertake to deliver to our customers only goods in perfect condition and in accordance with the specifications or properties usual for the given type of goods, complying with the given standards, regulations and orders valid in the Slovak Republic.
The condition for the validity of our electronic order is to fill in all the required data and requirements specified in the order form. The order is also a draft purchase contract, where the purchase contract itself is formed by the e-mail confirmation of the order by the seller. In individual, especially more expensive cases, the seller reserves the right to form a contract by confirming the order, preferably in person or by phone, and by paying the buyer a financial deposit. The buyer acquires ownership of the goods only upon full payment of the full purchase price for the goods.
If, during the period when the goods were ordered, there was a significant change in the foreign exchange rate or a change in the price or the supplied assortment by the supplier, our company has the right to modify the order after agreement with the buyer or to unilaterally withdraw from it with immediate effect. We reserve the same right in the event that the manufacturer stops supplying the ordered product or launches a new version of the product, or significantly changes the price of the product.

3.1 Registration
Before shopping, we recommend that you register on our e-shop by clicking on the link "Sign in".
Enter your email and password in the registration form.
After filling in the data, click on the link "Register"
After this step, you will be redirected to the "My Account" section where you can change your billing information, delivery address, view orders, cancel orders, etc. You will also be sent an email with a link to this created account.
On your next visit, you can log in to our site using the link "Sign in".
3.2 Selecting and ordering goods
You can select goods by category on the left side, or in the main menu of the site. You can put the selected goods in the shopping cart by clicking the button "Add to cart". You can add more items to your cart, and you can convert all items to the final price in the shopping cart. Before submitting your order, you must check the box "I have read the Terms and Conditions" to indicate that you have read and understood these Terms and Conditions. After submitting your order, your order will be processed and a confirmation of receipt of the order by the seller will be sent to your email address; if necessary, all other information regarding your order will be sent to the provided email address. If the goods are not currently in stock, you will be informed of this fact immediately.
3.3 Shipping
Before completing your order, you have the option to choose the type of shipping:

For selected products, shipping is free.
Shipping by courier – The courier will deliver the goods to you personally to the specified address. We will inform you of the shipment of the goods by email or SMS. The courier usually delivers the goods between 8 am and 6 pm. The customer is obliged to check the integrity and completeness of the shipment on the day of receipt of the goods. If the shipment is found to be damaged, it is necessary to report the damage to the shipment no later than 24 hours after receipt of the package to info@ehpspump.com or straight to the courier company https://claims.packeta.com/en. Any later complaints about the quantity and physical damage of the goods will not be accepted by Vladimír Kyseľ - RepCentral!
Personal collection - The ordered goods can also be collected in person at our collection point: Vladimír Kyseľ - RepCentral, Michalovská 2A, 04011 Košice, tel.: +421 904 494 989. The option for personal collection must be stated in the order so that we can prepare the goods for you in advance. When collecting in person, you do not pay the shipping price.

If the buyer, without prior written withdrawal from the contract, does not take over the goods at the place designated by the buyer and/or within the time frame agreed upon by the courier with the buyer in advance, the seller is entitled to claim compensation for the damage incurred in the amount of the actual costs of attempting to unsuccessfully deliver the order.
3.4 Payment
Before completing the order, you must choose a payment method, namely:

A tax document (invoice) is delivered together with the goods and by e-mail. In the case of personal collection of goods, you will receive these documents in person together with the goods.
By credit/debit card - Online payments are made through the Comgate payment gateway. The provider of the service, Comgate a.s. is a licensed payment institution under the supervision of the Czech National Bank. Card payment is the most common payment method. Comgate payment gateway supports Visa, Visa Electron, Mastercard and Maestro cards as well as Apple Pay and Google Pay payments, where the customer pays with a card stored in Apple/Google Wallet.

3.5 Prices for goods
Prices are set according to the current price list of goods at the time of order. All prices are listed including VAT 23%. All promotions are valid until stocks last, unless otherwise stated for a specific product. In the event that the price of the goods is stated incorrectly on the e-commerce website and the buyer subsequently orders it, the buyer will be notified by the seller immediately upon discovering this fact. In such a case, the buyer, as well as the seller, may withdraw from the purchase contract.
3.6 Part for exchange
In the event of purchasing goods "Part for exchange" in which the customer is obliged to return the old part, a "Surcharge for returning the old part" (hereinafter referred to as the Surcharge) may be charged to the purchased goods. In the event that the surcharge is not stated for the price of the goods on the e-commerce website and the buyer subsequently orders it, the buyer will be notified immediately upon discovery of this fact.
The order is accepted within 24 hours, we will send you an order confirmation by e-mail. We will of course contact you in case of misunderstandings.
You can cancel any order within 24 hours by phone or email without giving a reason. Just provide your order number. If your order has already been paid for, we will refund your money to the account from which you paid within 14 days at the latest.
All orders are shipped the next businnes day by Packeta company and then they are distributed to a specific carrier in a specific country.

When collecting fragile goods from the courier or from the pick-up point, please check the goods directly at the place, or in the presence of the courier, for possible damage by the transport company. If the goods are damaged, please contact the Packeta company as the first step to avoid complications when making a claim.

It is determined by the number of days from the submission of the shipment to its delivery, storage, or the time of notification of its arrival/storage. It is indicated by the abbreviation D + X, where "D" is the day of submission of the shipment and "X" is a number indicating the number of days. The delivery time is not guaranteed and depends on the conditions of the carrier.
If necessary, we will exchange unused and undamaged goods for another type. Exchange of goods can be carried out within 30 days of receipt of the goods, after 30 days we do not accept exchanges of goods. We only exchange goods for goods of the same or higher price level. It is enough to send the goods by registered parcel (not cash on delivery C.O.D.) to our address by courier company or by post. The costs of transport associated with the exchange are borne in full by the buyer. This does not affect the right to return the goods within 30 days.
The goods for exchange must be:

– undamaged
– complete (including the package leaflet, etc.)
– in the original (undamaged or otherwise damaged) packaging
Electrical parts cannot be exchanged.
The buyer and the seller have agreed that the buyer, if he is a natural person, will notify the seller of his name and surname, permanent address including postal code, telephone number and e-mail address.
The buyer and the seller have agreed that the buyer, if he is a legal entity or a sole proprietor, will notify the seller of his business name, registered office address including postal code, company ID, VAT number, telephone number and e-mail address.
The buyer may express his consent pursuant to the provisions of Section 11, paragraph 1 of Act No. 122/2013 Coll. by checking the relevant box before sending the order. on the Protection of Personal Data, as amended (hereinafter referred to as the "Act"), that the Seller processes and stores his personal data in all of his information systems, in particular the data listed above and/or which are necessary for the Seller's activities relating to sending information about new products, discounts and promotions on the goods offered and processes them in all of his information systems relating to sending information about new products, discounts and promotions on the goods offered. The Seller declares that the consent of the data subject will not be enforced or conditioned by the threat of refusal of the contractual relationship, service, goods or obligation imposed on the Seller.
The Buyer grants this consent for a fixed period until the purpose of processing the Buyer's personal data is fulfilled. The Seller shall ensure the immediate destruction of the Buyer's personal data upon fulfillment of the purpose of processing. The Buyer may withdraw consent to the processing of personal data at any time in writing. The consent also expires upon online cancellation of registration, or within 1 month of the delivery of the withdrawal of consent by the buyer to the seller. In such a case, the seller is obliged to irretrievably destroy all personal data of the buyer that it has stored and processed.
The seller hereby informs the buyer that, pursuant to the provisions of § 10, paragraph 3, letter b) of Act No. 122/2013 Coll. on the protection of personal data and on amendments and supplements to certain acts, as amended (hereinafter referred to as the "Privacy Act"), the seller, as the controller, will process the buyer's personal data in the process of concluding a purchase contract without his consent as the data subject, since the processing of the buyer's personal data will be carried out by the seller in pre-contractual relations with the buyer and the processing of the buyer's personal data is necessary for the performance of the purchase contract, in which the buyer acts as one of the contracting parties.
Before sending the order, the buyer will be asked to confirm by checking the box before sending the order that the seller has notified him in a sufficient, understandable and unmistakable manner:
a) his identification data,
b) the identification data of the third party, which is the company that will deliver the ordered goods to the buyer, so that these data are stated in the acceptance,
c) the purpose of processing personal data, which is the conclusion of a purchase contract between the seller and the buyer,
d) that he will process the buyer's personal data in the scope of name and surname, permanent address including zip code, telephone number and email address, if the buyer is a natural person and in the scope of business name, registered office address including zip code, company ID, telephone number and email address if the buyer is a legal entity,
e) that the buyer is obliged to provide the requested personal data,
The buyer can check and change the provided personal data at any time, as well as cancel his registration after logging in to the website www.ehpspump.com in the "My account" section (of course only in the case of customer registration)
The Seller undertakes to process personal data in accordance with good morals, to handle and dispose of the Buyer's personal data in accordance with the Act and other applicable legal regulations of the Slovak Republic, to act in a manner that does not contradict the Act or other generally binding legal regulations, nor to circumvent them, and to use the provided personal data only for the purpose of concluding and fulfilling the contract based on the Seller's terms and conditions. The processed personal data will not be published, made available, or provided to a third party.
We will resolve any complaints to your satisfaction by individual agreement with you and in accordance with applicable law. The buyer is obliged to inspect the goods after receipt in order to detect any defects and damage. The buyer is obliged to immediately report any defects to the carrier and subsequently to our company. We are not liable for defects caused by the carrier. All goods are subject to a statutory warranty period of 24 months, unless otherwise stated for a specific product. The warranty period begins on the day the buyer receives the goods. The warranty only applies to manufacturing defects.
The warranty does not apply to:
a) defects caused by wear and tear during normal use
b) defects caused by improper use
c) defects caused by incorrect (unprofessional) assembly
d) defects caused by incorrect storage

3) Indicate the reason for the complaint and your address in the shipment
4) The shipment must contain a copy of the proof of purchase of the claimed goods in our store, our company's complaint form [icon name="fa-file-pdf-o"] (You do not need to fill out the form again if you filled out the online complaint form in the first step), a proof of assembly, a service report on the defective spare part (if available) that the buyer wants to complain about.
The seller will decide on the complaint immediately, in complex cases within 3 working days. In justified cases, especially if a complex technical assessment of the product's condition is required, no later than 30 days from the date of receive complained goods. After this period, the consumer has the right to withdraw from the contract or has the right to exchange the product for a new product.
The buyer - the consumer - has the right to contact the seller with a request for redress (by e-mail to info@ehpspump.com) if he is not satisfied with the way the seller handled his complaint or if he believes that the seller has violated his rights. If the seller responds negatively to this request or does not respond to it within 30 days of its sending, the consumer has the right to submit a proposal to initiate alternative dispute resolution with an alternative dispute resolution entity (hereinafter referred to as the ADR entity) pursuant to Act 391/2015 Coll. ADR entities are authorities and authorized legal entities pursuant to Section 3 of Act 391/2015 Coll. The consumer may submit a proposal in the manner specified in Section 12 of Act 391/2015 Coll.
The consumer may also submit a complaint via the alternative dispute resolution platform RSO, which is available online at https://ec.europa.eu/consumers/odr/main/index.cfm.
Alternative dispute resolution may only be used by a consumer – a natural person who, when concluding and performing a consumer contract, does not act within the scope of his business activity, employment or profession. Alternative dispute resolution only applies to disputes between a consumer and a seller arising from or related to a consumer contract. Alternative dispute resolution only applies to distance contracts. Alternative dispute resolution does not apply to disputes where the value of the dispute does not exceed EUR 20. The ADR entity may request the consumer to pay a fee for initiating alternative dispute resolution up to a maximum of EUR 5 including VAT.
The buyer is entitled to withdraw from the purchase contract without giving any reason in accordance with the provisions of § 7 et seq. of Act No. 102/2014 Coll. on consumer protection in distance selling (hereinafter referred to as the “Consumer Protection Act in Distance Selling”) within 30 days from the receipt of the goods, or from the date of conclusion of the contract for the provision of a service or a contract for the provision of electronic content not supplied on a tangible medium, if the seller has timely and properly fulfilled the information obligations pursuant to the provisions of § 3 of the Act on Consumer Protection in Distance Selling. The buyer has the right, within this period, to unpack and test the goods after receipt in a manner similar to that which is usual when purchasing in a classic “brick and mortar” store, to the extent necessary to determine the nature, characteristics and functioning of the goods. The buyer is responsible for any reduction in the value of the goods.
The provisions of these business and complaint terms and conditions expressly do not apply to entities not meeting the definition of a consumer set out in the provision of § 2 letter a) of Act 250/2007 Coll.
The buyer must withdraw from the contract in writing in a manner that leaves no doubt that the contract has been withdrawn, or in the form of a record on another durable medium or using the form - downloadable from the link below.

The withdrawal period is deemed to have been met if the notice of withdrawal from the contract was sent to the seller no later than the last day of the period pursuant to the provision of § 7 paragraph 1 of the Act on Consumer Protection in Distance Selling.
Given that in the event of withdrawal, the contract is cancelled from the beginning, the contracting parties will return or replace all mutually accepted performance. Therefore, please send the goods back together with the proof of purchase if possible:

– complete (including the package leaflet, etc.)
– in the original packaging
We recommend that you insure the goods. We do not accept C.O.D. (Cash on Delivery) shipments. We will refund the purchase price of the goods to you by transfer to your designated bank account or back to your Credit/Debit card (unless we agree otherwise), no later than within 14 days in accordance with the relevant provisions of the law.
In the event that the consumer withdraws from the contract and delivers to the seller goods with reduced value that are used, damaged or incomplete, the consumer shall reimburse the seller for the costs incurred in connection with the repair of the goods and their restoration to their original condition.
In accordance with Section 12(5) of the aforementioned Act, the consumer may not withdraw from a contract whose subject matter is the sale of goods made according to the consumer's special requirements or goods intended specifically for one consumer, or goods that cannot be returned due to their properties.
These General Terms and Conditions shall enter into force and effect on the date of their publication on the website www.ehpspump.com.
The Seller is entitled to change the wording of the General Terms and Conditions at any time at its own discretion. The new wording of the General Terms and Conditions shall enter into force on the date they are published on the website. The General Terms and Conditions valid until then shall cease to be valid and effective on the date of entry into force and effect of the new General Terms and Conditions.
Contracts and related legal relationships shall be governed by the General Terms and Conditions valid and effective at the time of conclusion of the contract.
